• Réunion CNLTI : Michel Sapin fixe les priorités pour 2014

    Michel SAPIN, ministre du Travail, de l’emploi, de la formation professionnelle et du dialogue social, a présidé Jeudi 5 décembre 2013, la commission nationale de lutte contre le travail illégal qui réunit les organisations professionnelles et syndicales et les ministères et organismes compétents.

    Les participants ont échangé, et souvent convergé, sur le constat des situations de travail illégal et les mesures du plan d’action à conduire en 2014.

     

    Les évolutions récentes observées en matière de fraude au détachement de travailleurs européens incitent à multiplier les efforts : de 38 000 en 2005, le nombre de déclarations est passé à 60 000 en 2012 et il sera probablement de 66 000 en 2013. Ils ont concerné 170 000 salariés en 2012 et devraient concerner 220 000 salariés en 2013, mais les situations non déclarées sont certainement bien plus nombreuses.

     

    Michel Sapin a présenté le plan de lutte du gouvernement pour l’année 2014, qui repose sur quatre volets :

     

    1. Une efficacité plus grande des contrôles, qui passe par un meilleur ciblage des pratiques déviantes, un renforcement des compétences des services de contrôle et leur coordination opérationnelle dans le cadre des CODAF. La réforme du système de l’inspection du travail qui prendra effet en 2014, permettra de renforcer son efficacité dans ce domaine.
    2. La prévention des fraudes dans les principales professions concernées par une meilleure concertation entre les partenaires sociaux et les Pouvoirs publics tant au niveau national que territorial.
    3. Le renforcement de notre arsenal juridique pour responsabiliser les maîtres d’ouvrage et les donneurs d’ordre quand ils recourent à des sous traitants multiples. Une proposition de loi sera prochainement discutée en ce sens.
    4. Enfin, l’action résolue au niveau européen sur le projet de directive d’application de la directive détachement, qui connaîtra une étape décisive lundi 9 décembre à la réunion des ministres européens du travail. La France défendra une position ferme pour obtenir un texte permettant un vrai renforcement des contrôles et pour responsabiliser les donneurs d’ordre.
